Next Systems warrants that the products will be free from material defects in materials and workmanship for the term set forth on the Product Warranty Chart.

EXCLUSION OF DECALS FROM LIMITED WARRANTY All decals, specifically including floor decals, are excluded from this limited warranty and sold as it. This exclusion is necessary due to (A) the high probability of improper use of cleaning and maintenance and of improper cleaning procedures in caring for the surface upon which the decals are installed, and (B) The variation in surfaces (such as floor tile cracks, etc.) upon which the decals will be installed. However, with proper installation and immediately waxing over decals they have been known to last from 3 to 6 years.
EXCLUSIONS. This Limited Warranty does not apply to: Products that have not been installed in accordance with the installation instructions provided by Next Systems, Inc. Products which have not been maintained and cleaned in accordance with the cleaning and maintenance procedures provided by Next Systems, Inc. Floor panels which have been damaged by the use of maintenance and/or cleaning equipment, including floor strippers and buffers, in contravention to the cleaning and maintenance procedures provided by Next Systems, Inc. All decal products, including floor decals, which are sold as is with no warranty. LIMITATIONS Next Systems expressly disclaims and excluded all other warranties, obligations, or liabilities, express or implied, oral or written, arising by law or otherwise, including the warranties merchantability, fitness for a particular purpose, no infringement or those arising from the course of performance, course or dealing or usage of trade. In no event will Next Systems or its suppliers be liable for any indirect, punitive, special, incidental or consequential damages (including, with out limitation, loss of business profit, revenue, profits, goodwill use, or other economic advantage), however they arise, whether in breach of contract, breach of warranty, or in tort, including negligence, or under any other theory of liability in law or equity. NO OTHER REPRESENTATIONS. You may not rely on any other warranty or representation other than as expressly set forth in this LIMITED WARRANTY, and no one, including a sales representative, is authorized to make any warranty or representation other than as set forth in this LIMITED WARRANTY. REMEDY FOR BREACH OF WARRANTY Your sole and exclusive remedy and Next Systems’ entire liability for breach of warranty will be the repair, or at Next Systems’ option and expense, replacement of the defective product. In all instances of product repair or replacement under this warranty, you will be responsible for the costs of shipping the product to Next Systems and Next Systems will be responsible for the costs of shipping and/or returning the repaired or replacement product to you.
